Client Agreement
These Terms and Conditions govern all photography, cinematography, booking, licensing, and client deliverables provided by Barney Photography.
Last updated September 2026Barney Photography provides bespoke photography, artistic direction, and cinematography services across weddings, portraits, commercial campaigns, family, and maternity sessions. All engagements are carried out with artistic discretion and professional equipment.
Dates are strictly reserved on a first-come, first-confirmed basis upon receipt of a signed agreement (or booking confirmation) and a non-refundable reservation retainer fee (typically 50% of the total quote). The retainer covers mandatory calendar lock-out and preparatory logistics. The balance is due strictly before or on the day of the shoot.
Rescheduling requests must be provided in writing at least 14 days prior for portrait sessions and 30 days prior for weddings, subject to photographer calendar availability. Retainers remain non-refundable upon client cancellation. If Barney Photography cannot perform due to severe illness or force majeure, all monies paid (including the retainer) will be refunded immediately or a vetted associate photographer of equal caliber provided.
Pursuant to the Nigerian Copyright Act 2022 and international copyright treaties, Barney Photography retains full, exclusive statutory copyright in all photographs, motion footage, and artistic works created during the session.
Clients receive a perpetual, non-exclusive, non-transferable personal license to share, print, and display finished images for personal, non-commercial purposes. Commercial clients receive commercial usage licenses explicitly defined in their invoice. Images may not be sub-licensed, resold, or submitted to third-party commercial entities without prior written approval.
Barney Photography does not deliver or release unedited RAW files under any circumstance. Curation, color grading, and editorial finishing are an inseparable signature of our artistic craft.
Clients grant Barney Photography permission to display select images from the session in our portfolio, website, editorial submissions, and professional marketing. Private clients requiring complete confidentiality may request an NDA/Private Delivery prior to the session date.
Curated high-resolution deliverables are provided via our private digital gallery portal. Galleries remain active for a minimum of 90 days from the delivery notification. Clients must download their full gallery offline. Re-uploading or retrieving files from deep storage after 90 days may incur an administrative archival fee.
In the unlikely event of total photographic failure due to unforeseen mechanical breakdown, media corruption, or circumstances beyond reasonable control, Barney Photography's liability is strictly limited to a full refund of all monies paid by the client for the affected assignment.
These Terms are governed by and construed in accordance with the Laws of the Federal Republic of Nigeria. Any disputes arising out of these terms shall be submitted to the exclusive jurisdiction of the competent courts in Lagos State, Nigeria.
